DIVORCE MEDIATION: Why Mediation?


Benefits of mediation Over Contest. This does not include consultation with your attorneys or preparation of your Property Settlement Agreement. However, since your attorneys act as legal advisors during the mediation process and don't have to spend numerous hours preparing for trial as in a contested divorce, your legal fees will be dramatically less. You will generally save at least the expense of one attorney. The Mediator can prepare the Property Settlement Agreement (PSA) and all final divorce documents as a "scribe" should the parties so chose.

Collaborative Divorce

Avoid expensive and stressful courtroom battles. A private way to decide the terms of your divorce.
You and your spouse keep control of the process, with a focus on the future, and financial and other personal information remains private. Each spouse has his or her own attorney, but everyone works together cooperatively, which helps to resolve disputes respectfully and in a dignified, more productive manner. Time normally spent preparing for litigation is instead applied to negotiating a positive outcome for the whole family, which results in a much less stressful environment, especially for children.

Process: Once the parties reach a mutually agreeable settlement through conferences and discussions, the attorneys draft legally binding documents, which are then submitted to the Court. These documents typically include a Complaint for Divorce, a signed Matrimonial Settlement Agreement, and a Final Judgment of Divorce.

Benefits of Collaborative Law Divorce: Rather than relying upon a judge to make impersonal decisions about your future in accordance with state guidelines, you are capable of retaining control in the decisions that must be made and in managing the cost of the entire process.

What is Deferred Action for Childhood Arrivals (DACA)?

Deferred action for would-be DREAMers means that people who otherwise would be subject to removal proceedings or who already have removal orders, will not be deported temporarily for two years in this program. Deferred action is not an amnesty. It is just a deferral of removal proceedings for a temporary period, in this case, two years, with the possibility of renewals.

Briefly, the requirements are that applicants must have:
1. Been under 31 on June 15, 2012;
2. Came to the US while under age 16;
3. Continuously resided in the US from June 15, 2007 until the present, except for "brief, continuous and casual" absences;
4. Been physically present in the US on June 15, 2012 and at time of application;
5. Be in school, received a high school diploma or GED, or served honorably in the military;
6. Must follow specific application instructions;
7. Entered without inspection before June 15, 2012 or valid status expired as of June 15, 2012;
8. No felonies, no "significant misdemeanors", and no more than two non-significant misdemeanors, and is otherwise not a threat to national security or public safety;
9. Individuals never in removal proceedings, who are in proceedings but not detained, or who have outstanding removal orders must be at least 15 in order to apply. Individuals who are detained in removal proceedings may be under 15 to apply;
10. Proof of economic necessity is required for work authorization.
